Renowned restaurant sued over alleged time and attendance violations

An Italian restaurant in the New York City borough of Queens was recently sued over alleged time and attendance violations by eight former employees, according to the Times Ledger.

The waitstaff filed a class action lawsuit against Trattoria L'Incontro and its owners on behalf of employees who worked for the restaurant as waiters or busboys during the past six years. The lead plaintiffs claim they were not paid in accordance with minimum wage requirements or adequately compensated for overtime employee attendance.

According to the state Department of Labor's website, food service workers are supposed to receive an hourly wage of at least $5, provided their tip totals allow them to earn at least $7.25, which is minimum wage in New York.

The restaurant's website notes that it has been awarded numerous accolades, including being named the best restaurant in Queens by Zagat and receiving favorable reviews from The New York Times.
